This is what I understand, but what the EPA actually has in mind may differ.
It only affects engines that were originally EPA certified by the manufacturer in 2018 or later. Older cars are grandfathered in and custom-built engines probably don't count.

The anti-tampering law has always been on the books, but it was never enforced by the feds down to individuals. There is mainly local enforcement by states with varying levels of emissions tests and inspections. They feel emissions tampering causes pollution which is a public nuisance.

The EPA wants to be able to levy fines on any cars found in violation. The EPA wants to enforce it on private property such as racetracks, but IMHO there is no practical way to do this. If they unleash the "tampering police" on a crowded racetrack, it could get pretty ugly.

Some have said this law has already passed since the EPA buried it in another piece of legislation. Any truth to this?

They are trying to close the loophole that allows aftermarket parts makers to sell parts "for offroad use only." They tried to sneak in the definition that essentially says no auto can ever be classified as an offroad vehicle--meaning it will be illegal for parts companies to sell racing car parts for modified production racing only vehicles. This will kill the industry and in turn obviously affect every enthusiast, racing shop, their families, etc.

SEMA has issued a press release informing the public that the U.S. Environmental Protection Agency (EPA) is aiming to make it illegal to convert automobiles originally designed for on-road use into racecars, even though such conversions have been done for decades.

Under the EPA’s proposed rule, it would also be illegal to sell any performance-related products for those cars. The EPA’s proposal would have a devastating impact on motorsports since many types of racing rely on production vehicles that have been modified for use strictly at the track.

I was very surprised that our local newspaper, "The Dayton Daily News", (OH) had an article about this in today's paper. Hell they barely cover the Daytona 500, or the US Nationals and there it was a quarter page article about the EPA's recent power grab. The article tried to say it was simply a clarification of language in existing emission laws, but we know better. Looks like their BS is gaining some traction. We need to do what we can to stop it.
