I guess part 'b' of my question would be - if this thing isn't legal to sell in Calfornia, how did the California based dealer acquire it? (I did send them an email requesting some info but no response as of yet - guessing I won't get one). I would assume they would need to have the car in their name to legally sell it?
I can't imagine a dealership selling a car with an open title but who knows... |

Some kind of misguided trade-in? Buying/titling it is easy, registering it for actual use is not. They probably have the quitclaim signature on the guy's original title and whoever buys it fills in the designee portion, and the car will never have actually been owned by the dealership.

Smog
That car has a Chevy 305 in it which I assume is factory? It might have a boatload of back reg. fee's on it if it wasn't non-opt. The seller is responsible for smog. Period. If your buyer agrees to get it smogged great, if they decide to come back on you for it you'll lose. Anything 2000 and newer just gets plugged in (No pending codes, monitors not set), gas cap tested and you're good. 1999 and older not full time AWD goes on the rollers. My 95 Jeep failed twice in a row (4.0) which are known for high NOX levels. So...after a new exhaust manifold, O2 sensor and de-carboning the engine. It passed with flying colors. Registration on this 28 year old vehicle? $137.00 per year.
Here's a poor sap that bought a vehicle from an auction. Yikes...There 4 more codes on the back I didn't snap a pic of.

I believe counties with less than 50,000 people are exempt from emission testing including transfer... Modoc county.. Siskiyou county.. etc..

Partially true. Some high population counties (Riverside, San Diego, San Bernardino) are split between their western metro areas and the mountain/desert east in regards to emissions testing. You can live 35 miles east of downtown San Diego and be test free.

Exempt from testing, except on transfer. Vehicles must be smogged on transfer in every county of the state. A lot easier if it's in a Two Speed Idle county vs a dyno county which also measures NOx, which is usually high in older cars with worn out catalytic converters.

Makes sense, the 81 C4 turbo equipped cars had to be cleaner emission wise.
I always hated working on the '81's.

Likewise. That was the very early C-3---C-4 Delco computerized system. Very time consuming to run down an illuminated Check Engine light. And remember the yellow plastic EMISSIONS flag that would pop up at 30K miles and block off the odometer? What a bunch of CRAP. Glad those days are behind me.

I sold a 1966 VW project way back when , cars had to still pass a sniffer and equipment test. I had the buyer sign a bill of sale "as - is" and that they would be responsible for the smog inspection.

That was prior to 1998. Jan of 1998, the rules became 1976 to the present for gasoline vehicles. In 1997, I had a 1973 Chrysler with tags that were due in December. I just waited until January and paid a very small late fee without dealing with the smogging process although it would have easily passed. I take exceptionally good care of my vehicles.
