Default Andy Mitchell & Outlaw Racing Engines

It pains me to write this but I bought a set of heads from Andy Mitchell on Ebay back in June. I paid for them after having a couple of nice long chats with him on the phone.

Bottom line, last time I heard from him was September 2nd. He has not returned phone calls, e-mails (both through e-bay and just e-mail), and paypal requests.

Yes, stupid me for waiting so long to take action. That is my fault for trusting him and his reputation. I wanted him to do a little additional port work/cleanup on the heads and was going to pay him the difference and he agreed.

Stupid me for saying I wasn't in a big hury and was still undecided on what cam I was going to go with (flat tappet or roller). We were even discussing trading my Wenzlers for rotating assy and valvetrain parts.

I was figuring something happened (who knows, went back to the UK or something). Well, he has had the time to list more stuff on Ebay to include a car but not the time to respond to his customers.

Yes I have reported this to both Ebay and paypal and I am about to report him on www.ic3.gov, the bbb, and open a local complaint with my police dept and his.

Andy Mitchell, if you read this I think you will have to admit that I have been more than fair and patient with you on this. I do not believe you intended go out and rip me off, but I now have no doubt that you have no intentions to honor your commitment. You did leave me positive feedback and I really enjoyed our chats, however, you have not returned several attempts from me to contact you and you have not responded to my two paypal money requests. I find this most unfortunate to air dirty laundry publically

Mr. Mitchell, right now I suspect you are willingly commiting fraud against me and your recent ebay feedback further enforces that belief. Mr. Mitchell, I am one stuborn, hard headed, and principle based man. I ignorantly trusted you in good faith. I accept my responsibility for that. If you don't refund the $800.00 I paid you in June, I will press charges against you and I will fly out to California (Govt space available) this spring while I am on retirement leave from the Army to testify against you and take you to small claims court.

Mr. Mitchell and Outlaw Racing CA, I John Hudson give you my word that I will follow through with this. I accept this may cost me a lot more money than the $800.00 you have of mine but this is a principle and integrity issue, not just a money issue now. I won't blow this off, I absolutely promise you that.

If you refund my money, I will gladly come back to this post and state this issue is closed.

If you're a victim of fraud, DO SOMETHING ABOUT IT!!

"This is very sad and frusterating. I am at fault for being a bit ignorant and naive.

All I can say is that I will fight like hell over this, I am not one that takes getting screwed over well. Sometimes stuff happens and mistakes are made. That is one thing but to steal is another. This is bad not only for the Pontiac community, but our entire hobbyist community.

For those of us that have been ripped off by guys like him, or tri-y headder builders, or custom valve cover makers etc, we need to take action. Spreading the word on these forums is not enough. Yes, you can tarnish a guys reputation (actually they did it to themselves) but unless you open criminal proceedings and official complaints, these people and others like them will continue to steal from us. We worked hard and earned our money, we gave them the chance to earn our money and they stole it. That is absolute crap and unacceptable.

For those of us that have been duped, take real action....PLEASE... You can prevent someone else from getting ripped off and perhaps get these guys incarcerated. I have dealt with Andy and he gave me a helluva good deal for an IA block and a forged crank. Packaged very well and it got here long before expected. Nice guy to talk to on the phone!

i started to buy a set of his e heads first part of this year and second guessed it and went with sd. glad i did now.

on another note.......i guess if he does get those pontiac sportsman blocks worked out he may not have anyone to buy them

Did you get a tracking number?

You mentioned paying with Pay Pal, did you use a credit card?

We ALWAYS use a credit card for Pay Pay purchases. I got ripped off for $880 about a year ago and quickly got all of my money refunded by my credit card company.

I haven't talk to Andy in years, but he always seemed to be a decent guy and not one that would take your money and run with it.

I think he worked for or with Bruce Fulper for a while, if it's the same guy I'm thinking of?.....Cliff

I am still waiting on some valve springs and retainers here. This guy is so full of bull**** that the half could be enough. He can be glad that I dont live in California.

I posted this earier on PZ. Unfortunately, my case doesn't look like its going to have a peaceful ending...but...


I meant every word in my statement...every word!!

Today was my deadline hence my "smallish" comments in hopes this would be resolved by now.

It's been 9 days since he has contacted me and stated the heads would go out this past Monday. At this time, I have not received any additional updates or any shipping information (tracking numbers or method of delivery) via phone or e-mail.

Andy Mitchell: I publicly inform you that your time is up. My attorney's office will be contacting you shortly. Any corresponcence you have for me can go through them (Translation: Don't call or e-mail me anymore) or you may post on this forum if you so desire. I have contacted the BBB and paypal to let them know this issue was not resolved and that I am ready to take further measures.

It's really tragic to see people with talent and knowledge and abilities squander them or take the fast buck. Oh well, he did this to himself, we didn't do it to him.

My coments will be limited to protect myself from any "slander" charges.

Many people have contacted me on this forum and PZ who have been duped by Mr. Mitchell. If you will send me your contact information, general details (dates & amounts surrendered) and most importantly, your permission, I will add them to the criminal suit/file. I will discuss with my attorneys about a possible class action suit but I am much more interested in the criminal side. If you have an attorney that you would like to get in contact with mine, let me know and I will collect that info and pass it mine as well as my local and California Law Enforcement. I also encourage you to contact and file with your local police department. No doubt, this will soon become a federal matter since these incidents are innerstate commerce violations.

I sincerely hope you others that were duped by the header and valve cover vendors will take similar actions.

I got riipped off while using Paypal also. Only got back 75 bucks out of 550 in my case. Beware. -Jim

I used to buy parts off Andy when he lived over here,never had a problem as I always met him face to face to collect the parts. However, when he left for the States I had a set of headers due to me via a third party deal, when they turned up they were 1 5/8" not the 1 3/4" I paid for. I didn't follow up on it because it could have been a misunderstanding. Since then I have heard of a couple of guys over here that were owed parts or money when he left for the States, and a friend of mine who had an engine built by Andy, lost a rod bearing on the first pass,Andy promised to put it good but left the country shortly afterwards,without a word.

When I used paypal on this transaction I used my debit card just because I hate owing money to the credit cards. Every time I make a paypal transaction, I now use the cc and move the money over. Yep, a painful lesson.

Not to change the subject, but speaking of Paypal and E-bay, they both got me for a combined $1590. Seems someone who pays for something they bid on can just ask for their money back and in my case, they gave the money back but then wouldn't credit me the fees they charged me for the transaction. I will never deal with them again. Seems to me they give sellers no protection at all against fraudulant bidders. Users beware!
