Dead beats are part of doing business, I hate it, but it doesn't define what I do.

I think of it like throwing darts, every now and then one puts a hole in the wall!

Sooo....is this white Pontiac GTO RAIV Convertible thats being sold at MECUM Auction on January 24-29 at Kissimmee, FL "possibly" subject to recovery by original owner (if court rules): Dan in this case?

From similiar cases of cloud on titles / ownership I have read in the hobby, will they go back to "lawful" owner and others are out the money they paid?

Will they prosecute (or fine) those involved based on any experience here?

Richard S. posted the VA lien sale process...explained in detail, and whats been posted I
personally, wouldnt "touch" this one.

Being in Greg's shoes with money in hand I just might have bought the car too.
requirements were met according to TWO states that issued clear title. I'll bet a $100 bill that the car is untouchable now by litigation...maybe the shopowner's assets...but not the car. Besides...Greg has put as much or more into the car than he initially paid and has receipts. No sir...I believe the car will sell at Mecum without a hitch...but I guess time will tell. I guess my lack of compassion towards Dan stems from the fact that he paid $40k for the car and was asking $140k without touching the car. That's fine...but he of all people should understand the greed that drives this whole situation. Business is ruthless! JMHO. Ron

Anybody can ask what they want, (140k) selling it for that is a different story.

Dan or Greg buy a car and make a mint good for them!

My RA IV Judge I bought back in the 80's paid 6500 with two pickups trucks worth of parts that I sold so I started out in the car zero.

Car is worth probably 100k more than I am in it. Doesn't make me greedy nor will ever sell it, my oldest son will get it someday.

Greed is a strange perception..............Don't really understand it, one man's greed is another man's gold mine.

IF a criminal investigation is ongoing per a post in this thread, and someone used Broad...Title...I'd be sweating bullets right about now.

Basic common sense tells us per Richards post re: process of a mechanic lein in VA that it sure doesnt sound from the posts like the letter of the law was followed...imo.... but I wasnt there.

Couple of situations covered in the hobby last few years saw two cars with murky transfer of title involving musclecars that went back to original owners.

Default Update:

For those of you who may be interested in the outcome of the litigation involving my 70 GTO convertible, on September 18, 2013 an order pertaining to the vehicle was executed by a Circuit Judge in Fairfax County, Virginia. Following a 3 day jury trial, the jury found in my favor for breach of contract against Automotive Repair Group, LLC (ARG); conversion against ARG and Forza Automotive, Inc.; and fraud against Nick Yawer. I was awarded compensatory damages against ARG, Forza Automotive, Inc. and Nick Yawer and punitive damages personally against Nick Yawer. Collective total damages were awarded in excess of $100,000. Additional steps are now being taken with respect to the judgment.

good deal. I just hope they have some assets for you to collect on. Is there anyway that they can make the car come home to you??? I am sure not, but who knows as it seems like it should fall under the " stolen car " category.

The silence is deafening!

That's where the problem is Gary - collecting. Dan has spent a bit of coin pursuing this case but was emboldened when he found how many times this has been done in the past by Mr. Yawer. The individual Fraud charge is nearly impossible to prove in many cases, yet here it was done. Mr. Yawer can choose to make restitution or be chased for 40 years - any time he gets a new job, his wages can be garnished, buys a car or a house, have it attached. I don't know any one who would choose to live that kind of life.

Dan has the conviction and the means to pursue this case until it is done.
