View Full Version : Proper procedure for handling bad deal on this board?

Hi, need help, whats the proper procedure to complain/whine about not getting my parts from a member of this board? It's been a month since the person got my check and nothing but excuses. I still dont have the parts. Last communication person said they whent out this past Sat, 7 days later, still no parts. I paid with a Postal M/O, his request, now what do I do? thanks, marxjunk

hmm

Money order shipped to person: 3 days
Him cashing money order - bank possibly putting hold on funds - 3 days
him pulling the part off the car or finding it: few days
him packaging the item up well, finding box...packing material (could be difficult) - 3 or 4 days
him getting to the post office: a few more days
him shipping the item the slowest route: 10 days
(parcel post is 6 days shipping - but that doesn't count weekends (or today's holiday) and doesn't count if he shipped it later in the day, when they were near closing)

give it a few days and see if it shows up

sounds like he's slow - but not yet unreasonable

guess it depends what the item is - if it's something that's easy to send or if he's cutting a quarter panel off a car

it's a pain in the ass to ship some stuff

Without naming names, is it someone who's been here for a while or are they a new or infrequent visitor? I'd say make absolutely sure the deal's gone bad before you 'out' anyone, in case the delay is for legitimate reasons. Maybe give them a specific deadline for delivering the part, and if that doesn't work only then do you make the issue public.

YES, he's been here a while, a long while.. I am trying to control my temper, but, when i do my part on a speedy time frame, and the other guy says it's on it's way, an a month passes, i get p!ssed. I try not to be jerk but it just comes out in me. The parts where already off the car, they where underhood items. OH well, i'll wait a little longer, what else can i do? I dont want to "out" anyone until i know the times right. AS far as I am concerned, the deals already went bad,and i just hate it! Oh yeah, his reasons are he's busy.Ya know what, I just spent 11 days in Vegas for NACE, before that, I was on the road 2 weeks for work, and i'm busy too....but i found enough time to get a POSTAL M/O and sent it......

i'll out the guy.IT'S ME.;^(...sorry but he's right.i took too long to send the part.it is on its way.i do take long sometimes to send stuff.my pc has been down all week.just got it up after going crazy trying to recover all my old files and stuff.thats why i have'nt been on all week.AND the other parts are going out today.PLEASE FORGIVE ME.larry

I have never dealt with firebirdcrazy1959 but i do remember reading this thankyou post no long ago: http://216.178.81.108/forums/showthread.php?t=443047 . Seems he has had a few blips as far as a timely delivery but none the less, happy customers seems to be the general concensus.While i agree that things happen on the sellers end of it and agree that if that it happens, it should be mentioned to the buyer, i think sometimes we as buyers can get a little uncomfortable if it is not on our door within a couple of days and may tend to tell a little white lie to keep the peace momentarily.I see this gentleman selling parts frequently here and i would not hesitate to buy from him based on his consistant performance of delivering the goods.I personally ship the part out same day as the funds are received.Some people just want/need/expect the part within days and i don't want to deal with this type of situation.O.K. you have realized a few inconsistancies in his story, is it that bad you feel you need to threaten/tarnish someone to resolve this situation by giving him an ultimatum? I'm not saying you are wrong for this and i'm sure you don't care what i think. This gentleman has been around for awhile here on PY,although it can happen, i don't think he is a fly by nighter trying to scam people and you'll get your part/s, his track record seems to show that. Good luck and may there be a happy ending to this.

Well, i lost my temper, so i deleted my last post. I will let it go, if it doesnt show up by friday, i will worry about it then. I am not trying to "tarnish" anyones rep here. I just want the truth, and want my parts. So i am sorry if I offeneded anyone.

For what it's worth.
I've had plenty of more than a month deliverys on items purhased on E-bay.
If I really wanted it tomarrow I tell the person and in most cases they say sure just pay $$$ more.
But,
I've had my share of problems. Lost or destroyed packaging/items.
Computer Hd crash, I love Paypal for a reason. It cuts down the time.
IE.. Person gets money asap and the item ships faster?(sometimes)

I'd only get upset/concerned bout things if it takes more than 4 weeks/the seller didn't reply to my "Hey! where is my ??? at?"

Some people don't like Paypal and that's their thing.
But, I figure 3+ days on the Mailed MO
3 days for bank (Even some do this to UDPS mo's)
2 Days + for packaging and getting shipped.
Then 3+ days on shipping.
Sometimes Weekends will add 2 days more easy.
I've gotten the Money order on Sat after banks closed and by next thursday its cleared.

i am having the "excuse" routine given to me from a board member also. it has been a month now. payment was sent by credit card asap, after agreement on price of items.

if i don't have the items in a week, name will be posted......

i have dealt with some great people here, and some, well, that have not learned proper business etiquette and some that were outright dishonest.....

it would seem that selling a item or items, especially on a small board such as this, a person would have enough "sense" to deliver stuff in a reasonable amount of time, or describe the parts in a truthful manner..........

black cat-i'll try to ship monday,will be passing the ups store on my way home from a job site monday.

JUST REMEMBER ONE THING.i may be late shipping parts,BUT i've never not sent parts.
i understand how you feel marxjunk,again sorry.Now i can go play with my cars.i'm still having trouble with my PC.so if you don't here from me,it's the PC,not me hiding from you boys.:^)

You know its kinda hard to sell parts here and elsewhere when you don't do this full time. When someone buys something, they want it yesterday, and if you didn't send it the same day they paid, in their eyes..your late. Some people need to understand that we are not 100,000 sqft warehouses with about 40+ employees pulling parts all day, but a single person with a full time job, families, and other obligations. I've always shipped in a reasonable amount of time, but I have to hussle with my busy life style.

firebird went WAY out of his way to deal with this deadbeat ebayer for another forum member, i'm sure that delayed some of his deliveries as well. if i were on the other end waiting on something i'd certainly be cutting him ALOT of slack knowing he went above & beyond the call of duty on this one.....

After reading the story of the deadbeat e-bayer, I think Firebird definately needs some respect. Anyone that would go to those lengths is one helluva guy. Kuddos to Firebirdcrazy.

What would you guy's do if you bought a car from a guy on this board who advertised it as rust free and when I got it the sub fram (rear) is rusted badly and the dash by the pillar is also rusted thru. I trusted this guy because he is a long standing memeber here and that is why i did not go to see the car in person but believed the pics.I will never do that again.

I had a good comeback/smart a$$ remark, but will refrain. If I bought a car, and it wasn't as advertised, i would try to re-negotiate the price, if that didnt work I would demand a refund. If that didn't work here's what my lawyer told me to do.
Right now internet fraud is one of the biggest, fastest growing types of fraud in the world. Governments are being pressured to do something, so legislation is being accelerated to protect YOU. Your state attorney generals office is the place to turn. They will prosecute these things, with a vengence.

1, If ya paid with a postal m/o, he committed mail fraud, and the US government has more power than any lawyer. Get the receipt, take it to the post office, and fill out the paper work, they will take cqare of the rest.

2. If ya paid by credit card, and the guy wont refund some money, call them and contest the payment, they will pull it fom his account, without him having any power to stop it, unless he cleans out his account.

3. Contact your local courthouse, they will get you in touch with the right people.

4. CAll your states attorney general. Have all emails, copys of the ad, if it is posted on a website, and proof of payment. Take pictures of the problems, and print them to give as evidence.

5. Do all communications by email, keep track of them, print them off everytime ya get a response. Phone converstations are tough to prove, unless you record them.

6.Dont beat them up on a message board. If ya get petty, call names, out them, or what ever, it could be detrimental to your credibility.

7. Call his local sheriff's department, be polite, but cry like a baby, tell them ya got taken advantage of. They must make a report, and contact him. Trust me when a sheriff shows up, and questions him about internet fraud, you will get his attention.

There are websites, hundreds of them, dedicated to this growing problem, do a google search and do your homework, be prepared, Like Judge Judy says, It's your job to prove it, not hers!

Dont buy anything from this board or any, unless ya do some research into the persons credibility. ASK questions about the guy befor ya buy. If ya get pressures to buy without doing research until you satisfied, let it go,anyone serious about selling something, and has a good rep, will give ya time.Just because someones been a member of a board for a while, doesn't mean he's not capable of this type of act. Desperate people do desperate things, their personal circumstance at that time, may cause people to do things they would never even consider any other time in their life, but thats not a reasn to rip someone off intentionally.

Keep in mind that its not legal to record a phone conversation unless you notify the party on the other end that the coversation is being recorded.
At least that is what I was told...I tried that one time.

At least that is what I was told...I tried that one time.

Laws have changed since the patrioit act. It's not illegal to record YOUR phone conversation, it's illegal for a private citizen to record someone elses.As long as it's your phone conversation, ya don't have to notify the other person either.

NOPE, and 8 weeks is unacceptable, either get me a tracking# or send a refund, I've had enough. I have 3 pm's from you stating you shipped it 3 different times NOT GOING TO SHIP, ALREADY SHIPPED.

Just 3 weeks ago you stated you shipped it on saturday, and 2 weeks ago ya said it went out wednesday, 11 days passed and nothing............Look, the last thing I want is a hassle, and the last thing I want is to hassle you, but take a second to see why i am so aggrevated. I try to believe it's an oversight, but the proof is in the pudding, do the right thing and make it right.....please!

When I sell something, after the deal is made, I will package the part and have it ready to ship by the time the payment arrives. Usually everything works out, right now I have a set of headers packaged waiting for a check.... been 3 weeks...
When I recieve payment, the part goes out that day, having to wait for weeks is inexcusable!!!
If your busy and having personal problems like a lot of you are claiming, don't list the parts for sale!!

This is exactly how I conduct my business. And, I agree with what Bill said about weeks going by without a payment or without a delivery. Totally wrong and unexceptable. I will always do the right thing if my reputation is at stake, including refunding money if the customer is not satisfied.

BTW Bill, it was nice doing business with you. The parts I got from you were exactly as described! - Phil

Fire stated that It went out on Wendsday Nov 9th according to my guess.
Mine went out on the 14th and I got mine on the 17th
Have you gotten what carrier it was shipped by?

I honestly don't believe he is tyring to rip me off either, he brought alot of this attention to himself, by "outting" himself.
Now if he has done what he said, i have serious doubts. Instead of saying, i havent gotten around to it, he has stated 3 times, it has "been shipped", and those are the key words, not "i'm going to ship it, but, it has already been shipped".
To be honest, i'm past it, i just want results. I guarantee, if me, or a realatively new member pulled this crap, all the "regs" would crucify us, instead of supporting us.......It isn't the idea that it is late that sickens me, it's the constant story change. I was lied to.......period.

All you guys that want to beat me up screw it, go ahead. I have issues i guess, and i was looking for somewhere to hang out when i found this place.

i told you it was mailed last week.my boss dropped it off at the post office.i'm not giving you bull****.i did screw up.BUT IT IS SHIPPED.my boss did not get any delivery conformation.YOUR RIGHT I LIED.if your not happy,send me back the part.i'll even pay the return shipping.everyone else got their parts.i don't know why you haven't gotten yours.all this because of a f*#king car part.give me a break already.you can say what you want,i really don't care anymore.everyone knows me here,1 person giving me a bad feedback is not going to break me.maybe i'm wrong,but right now i don't care.i've got more importent things in my life to worry about than some god dam car part you didn't get.

marx, I had offered to help you as well. I think people want to think the best when things like this happen.

He admitted he was wrong, that's pretty stand up in my book.
