If your payment with paypal was thru your credit card I would have the charges disputed by the card issuer & they will give you a full refund. Most CC co's are on the consumers side & will go to bat for you. You do have a time limit to dispute a charge, usually 60-90 days.

Unfortunately a Mod at PY has decided to close the thread in the Performance parts for sale area(the scene of the crime) where this THIEF robbed me(Martin Robertson 505-263-9900). What is up with that? Unless he is dead there is no excuse. I paid him 585.00 bucks and was only able to recover from Paypal 72 dollars, 6 weeks later. Very frustrating. I hope this NEVER happens to anyone else here. -Jim

Steve, I had Paypal linked first to a Credit Card and then directly to my checking account. A few months ago i got an e-mail that I needed to renew the credit card link and I just never got around to it. Unfortuanately the money came straight from my checking. Everthing from here on will be on a CC. I like to trust people and you think coming on here as a part of the Pontiac community you could do that, but... I was wrong. -Jim

Your thread here is still linked to the thread I closed in the classifieds so there's still plenty of info there for reference. There is no need for further comments to be posted on the closed classified ad thread or to carry this on in two different threads.

Unfortunetly you were. I was too. I've been burnt by two or three guys on here. Nothing as severe as your situation; but WAY misrepresented parts that I bought from them. One guy from Canada took several weeks to ship me my wrong colored seat belts....These people are scum and will have an opportunity to answer for their actions some day and won't be able to hide behind their "caller I.D.". In the meantime; it will have to be an expensive learning experience....very sorry.

I had the same thing happen to me a couple years back. I purchased an item using paypal with my credit card for $300.00 and never received item. I filed a claim with paypal and they only could recover $6.00 and change!! I then contacted my C.C. company and they got me the full amount! WHAT'S UP WITH THAT!!! It looks to me like paypal runs it's own scams!! I was then notified by paypal informing me they had a claims dept. that I should use when I don't receive an item. Naturally it was sent in an e-mail I could not respond back informing them I had already done that for a $6.00 and change refund!

I filed a claim with paypal, stating item not recieved, for the full amount (585.00), and won the case because he did not answer the complaint. Paypal was only able to refund $72 because the rest of the money was gone from his Paypal account. According to Paypal they plan to take legal action to collect the rest. I doubt if I will ever see it. -Jim

Have you thought about filing a claim in small claim court? I'm not familiar with Georgia law, but most states are similar. You don't need an attorney, the claim form is relatively simple, and the filing fees are nominal. Once it's filed, he or his attorney need to appear in court. If they don't, you automatically get judgment in favor of you. With a judgment in hand, you can then get a legal garnishment on his wages. It's not much more work than you have already expended, but it would be worth it, IMO.

I had a problem with a damaged part I received and I screwed around with the guy for two months. I finally told him I was going to file small claims (no bluff, I was!) and he could spend 10 times more on an attorney or a plane ticket to appear in court. Golly, things got settled within a week. I was almost disappointed because I was looking forward to him telling the judge the same garbage he had been giving me.

These type of cases are exactly what small claims court is designed for. Anyway, just offering an option for you. For what it's worth............

Jim, I had a very similiar situation with buying some parts. Pay Pal was USELESS, the only recourse I had was through my credit card company.

I did contact my local Sheriff's office, and filed charges against the guy. Which they pursued until my Credit Card company reimbursed me for the losses. I still don't understand why they dropped the charges just because my Credit Card company stepped up. Didn't a crime still take place?

Plenty of guys out there doing this sort of thing. My purchase was through E-Bay. So I logged on to his other auctions and made high bids on them so I won them, then REFUSED to pay for the items until my first purchase was delivered. This also allowed me to post NEGATIVE feedback.

That probably wasn't the "politically" correct thing to do, but at least I knocked his feedback rating down to 78 percent in short order, and he ended up making his feedback "private", then ditching the account all together......Cliff

If I could find out if this guy has a real job I might file in magistrate court here, I am not sure if a judgement here would allow me to garnish his pay in New Mexico? If he has a bank account I could get a FiFa and go against that if he was here. FWIW, I have several rental properties and have used magistrate court in the past. If a deadbeat hides it is very difficult to serve and even harder to collect. Anyone here in the FBI? Any Federal laws involved/violated? 500.00 bucks enough to go after this bum? Thanks -Jim

Any transaction that done over the internet and or US mail is subject to the guidelines of mail fraud.
Go to your local post office and ask for the postmaster. Explain this to him and ask for the form. The post office will investigate and pursue and it doesnt cost you a dime.

the internet's a great place to commit fraud for a million reasons, primarily a near total lack of law enforcement.
as for paypal, nobody should ever use it for more then a couple hundred bucks in my opinion, or whatever amount you can afford to flat lose.

You are probably right but I still want to be able to trust people. UR2L8(Martin) had many posts here going back for several years, I researched him before I sent him money. I also believe in a Deadbeat sticky but if some people were to post some of the absolute JUNK parts they Spent a LOT of money buying from "RESPECTABLE" people on here it would start ww3!lol in any respect i wish you luck!, i also bought some heads for a lot of $ and had to finish the port work now they are getting 1000$ worth of rebuild to get them usable for racing:rolleyes:
