e-bay rape

Hi guys, just wanted to ask if anyone has any ideas on how to remedy my situation.I bought a motor on e bay that wasn't what they said it was.The problem is ,by the time my machinist realized it wasn't a 428 but instead a 400,it was too late to put in a claim to e- bay or to paypal.ANY IDEAS? Thanks guys,Tim.

Too late now but the 428 & 455 has a lug sticking up on the rear passenger side of the block by the distributor. Easy to spot if you are purchasing a engine. I don't know what ebay or paypal will or can do. Check and see what you can do.

Greg Reid 01-27-2015 01:11 PM

326 and 421 have the transfer lug too.
Tim, I'm assuming you have already contacted the seller? I have been pleasantly surprised twice by eBayers who refunded my money when I pointed out that what they sold me was not what they advertised. In both cases, I did not know until well after leaving positive feedback.
If that doesn't/didn't work and since you paid with paypal, I'm assuming a credit card purchase? Maybe you could dispute it through the CC company?

Yup. Forgot those two.

Thanks guys, credit card was paypal, they also told me that it's too late.I am rebuilding the 400 into a 428.I guess just wait and see.
Tim.

What year 400 is it? If it is good, you might be able to sell it and buy a 428.

fyrffytr1 01-27-2015 07:54 PM

I see that you are going to try arbitration so I guess you already contacted the seller and he refused to help.

mountaingoat 01-27-2015 10:42 PM

how long has it been? You have 60 days to file a dispute with your credit card. If the item you received was not the item you were purchasing you are protected, the seller has no recourse other than to pay for the return shipping, the funds will be yanked from his account. I didnt stay at a holiday inn last night, but I am an evil corporate banker.

ScottD3 01-28-2015 12:27 PM

I would dispute it thru your CC company. It's your credit card they will tend to be more on your side. Good Luck.

Hi guys,it's been about 8 months. My machinist didn't realize the difference until he measured the journals.I paid with paypal and they pretty much said the same thing as ebay.I mailed the papers to the arbitrator yesterday so we shall see. Thanks again for all you're responses.

If you're stuck with the 400, you can install a stroker kit and have your cubes, plus it'll be a stronger block than the 428. Make lemonade out of a lemon, so to speak.....

Matt Meaney 01-29-2015 11:05 PM

unless it's the dreaded "557" block

I've decided to rebuild this block to 428ci,thanks for all the great responses.I'll let everyone know about the outcome of the arbitration, and the engine.

Question
geeteeohguy said that the 400 block was stronger than the 428 block. Why is that?
Because of the main bearing sizes? I thought that the 428--67 4 bolt main block had a higher nickel content or did they all which was good and made it a stronger block. Yes/No

geeteeohguy 02-01-2015 01:38 PM

Yes. The 400 has more meat in the main bearing area, and the bearings are less prone to failure due to their smaller surface area. So you can run more RPM safely with a 3" journal than a 3.25" journal engine. All the blocks have the same high nickel content, at least from the '60's to the early '70's, as far as I know. The cheesy ones came out in the mid '70's.
