I think your driveshaft loop at the cross-member has way too big of an opening. If the U-joint failed, based on the pics, I think the driveshaft could possibly still tear up that nice body sheet metal.

As the hoop is at the front of the shaft and there is little vertical movement there, I would have no more than 1" of clearance around the tube.

Item two, can you post a pic of the driver's side of the round port tri-Y headers?
