Well....based on this all being "second hand" info and only assuming it to be accurate, in principle perhaps it should apply. But strategically, if the manufacturer strongly believes they'll end up in litigation, and views the complaintant as "hostile or slanderous" then their best approach from a legal standpoint is to let it go to court.

Again, a self imposed recall can be as narrow as the manufacturer chooses: the week,day or hour a product was made, color of skin,or number of nipples.

Only a court of law can determine whether the criteria used was fair and resonable.
