If that is the case then John, the Kauffman's should be going after the Foundry for the issues and refunding the money to all of the people who bought the bad blocks, (including Scott Roberts). Sueing a guy who is pi$$ed vs the Foundry (who you say caused the issue) seems to me to be a misguided defination of the root cause.
As far as the machining of the blocks go and those issues, they obviously have to fall on the Kauffman's shoulders. Do you agree?
