Today, I received a pair of '64 GTO grilles from a seller in Illinois. The pictures accompaning the auction made the grilles look really good. When opening the box, however, it is obvious they were welded in several places--both grilles. The grilles and welds were polished very well, but whoever welded them did not get the bars even close to parallel. Worse yet, the right side grille is misshapen around the headlight area so it would not fit over the headlight assy. I don't believe this could be easily corrected.
Buyer states he does not accept returns--has a 99.6% feedback rating with over 12,000 transactions. I emailed telling him I cannot use these grilles and requested $250 be refunded via PayPal. I will pay shipping both ways. If he does not cooperate, I'll try eBay Buyer Protection, which is something I've never done. I'll post seller's name and auction info after he responds to my email. Of 222 transactions I've made with eBay, this is the first time it went badly.

The seller responded quickly and agreed to take them back. Refund of $250 will be sent via PayPal when he gets the grilles back. I shipped them back today and expect all will be OK. Look under completed auctions for the seller info, etc. Compare the pictures he used for auction to the ones I took showing the poor workmanship of the welds and the squished end of the one grille.

why even post this then if you havnt even tried working things out. ??? I can see posting if he tells you to pound sand or something to that effect.

Pay pal will freeze 250 dollars in his paypal account till its resolved
your reason should be the item was not described accurately ( as in no mention of welding etc)

Be sure to do all communication via email. If he agrees to a return, you've got a solid case. If not, Ebay should stand behind you. Document everything and follow the protocol. Take some pictures showing they do not fit. If they were listed as "used" and not "for parts or not working" your case is stronger. By Ebay's definition "used" should be usable. I just went through this on a 64 console that was twisted on top. Ebay's process usually favors the buyer. That is after all who is making them money.

Dick, FYI you only have 45 days to open a dispute with ebay otherwise the seller can skate by. So don't let them draw out the solution. Your first action if they do not refund timely is to file a dispute with ebay, then open a claim with Paypal. This would immediately pull the money out of their account and hold it until you sign off on the dispute. You can also pull a user information request so you have their phone number, then call them. You should be fine since ebay is totally slanted in the buyer's favor.

Do you know who that is ?????? I do !!!!! That is one of the Major GM parts distributor around here. He has several different E-Bay account's and goes by several different name's,but we all know of him and his business and have used him in the past.I'll post the name of the business if it doesnt get me in any trouble.

bryansMtngto, I posted this out of frustration with a person that didn't honestly describe items for sale. Maybe someone else on this board can benefit from my experience yet to be played out. As I posted soon after, he agreed to accept a return even though his auctions state "no returns accepted."
I'm relieved that he agreed to refund, but disappointed that the description was not accurate--and that I still don't have usable '64 GTO grilles. Judging from his response, I don't expect problems getting the refund put in my PayPal account. I did an ebay dispute once with a knucklehead I bought an intake from. He jerked me around for a couple weeks with bogus tracking numbers, and he was sick, his dog ate it, he lost my address. They resolved it and I got the intake finally.

you can dispute it with ebay, not paypal, and ebay will decide. They favor the buyer. ANd they send you the shipping label to return it, and give you full refund. If they decide in your favor.

I don't think you can expect him to refund the money until you return the part as business just doesn't work that way. What few parts I've gotten refunds on I had to send the part back and THEN is when they credited VISA or sent me a refund check.
I would do it through PAYPal/Ebay and not outside on my own. Hope you get your refund. |
