I think if they knew and still took $ then thats willful Fraud punishable by law and maybe the bankruptcy could be stopped by the judge.

The chances of that are about zilch unless the creditor files a motion for exemption from automatic stay in the BK court. And even if the creditor does so, granting such a motion almost never prevails for unsecured creditors.

As above, if you can't get your credit card company involved, there's about a 99.9% chance you're screwed, blued and tattooed.
