Default eBay Shisters

The legal term is "theft by deception" and I just had the same situation as several other Pontiac folk have had on eBay and I paid via PayPal but neither eBay or PayPal will do anything about the situation.

I won an auction for a RA carb pan that the seller called very rare, hard to get and the pictures appeared to be of an original steel tub. It arrived in a Classic Industries box and was a $139.00 fiberglass repro. The seller would not take it back and said it was well worth the $247 I paid him.

Here was his response when I finally got through to him:

Dear Whomever:
I told more than ten individuals that felt compelled to ask the makeup of the Ram Air Pan that it was Fiberglass. They thanked me and did what they wanted. I am sorry that you have found other one's out there cheaper and feel like you did not get to take advantage of the situation. The sale is final. The goods are non refundable. Feel free to do with it what ever you want. You own it.

As you can see, he knew what he was selling was a repro but did not say so in his eBay description, but he also was carful not to say it was original. Guess I screwed up by not asking but the pics were good and it looked correct. Bottom line, it is not what sellers say, it's was they don't say and if you aren't precise in your questions, you get burned.

Awhile back on the website......www.northwestlegends.com...... a pontiac site from the northwest Seattle area, several other people on that site had warned about this person. You should post this info on there website as well. This is a good website full of good people. As this guy lives in that area, people on that site should be warned again.

on the other hand

as an ebay seller, you'd be surprised what some of the buyers will expect from you

i've sold cars where the engine was laying beside the car, to see the buyer show up and flip out when he can't drive it home, because i didn't say that it wasn't driveable


sounds like you got screwed - i'd take an awful good look at that picture and see if you can prove it not the one you got

I remember some info about this guy and a business he runs somewhere in the seattle area but what I remember wasn't that he took somebody's money for inferior or misrepresented parts. What I remember is that he was simply "strange" and he insulted people with his posts on northwest legends' website. I could be wrong though.

I'm sorry that you've been sold a fiberglass re-pop of a ram air pan when you thought that it was the real deal. That sucks !

ALWAYS ASK QUESTIONS! EVEN STUPID OR OBVIOUS ONES TO COVER YOUR BUTT!!! as too, an ebay seller, i get some real screwoffs bidding/buying, and they make ebay a horrible experience. i just give them their money back and add them to the "bidder's banned list" on ebay (myebay). leave a negative feedback, i hope you did! people do read it!

he totally misrep. that part and he knew it. i will stay away from those 2 sellers. sorry to hear about you experience. :smash:

did you REALLY think that was an original pan? did you look at the pics at all? the one pic is rough as hell. if you thought that was steal, i recommend getting your eyes checked. always remember, if it's to good to be true, then is probably is. buyer beware. pontiacmonstr

I just looked at the auction http://cgi.ebay.com/ebaymotors/ws/eB...category=34198 and It doesn't look like he is accurate in his description of the pan and he certainly must know that it is a repo. He should have disclosed this, he should also refund your money if you are not satisfied. He also deserves the feedback that you left . All that being said, it is also very apparent to me in this photo that this pan is made of fiberglass.

Gettin old in my old age. I let the first "large" picture of the bottom of the pan get me,,, stupid but at the same time, if he was ask ten times (per his email to me), why did he not put that in comments/questions ask and clarify the issue. DAH, if he had, no one would have bid on the item.

Thanks for the web sites, I will post there if I can. If youall can, feel free to copy my post and put it where ever you feel it would do the most good.

I notice the seller carefully worded his ad so that he never specified that it was a repop or said it was an original base. I realize it is buyer beware but this auction was meant to intentionally deceive bidders from the beginning by the way it was written.

Hard-Timess I'm sorry you got burned by this clown. I know some people will say you should have asked the stupid questions, but the sellers should be responsible enough to have an accurate and honset description in their listings.

I'd like to see a seperate forum setup by PY so users can post their experiences with bad ebayers and hopefully warn others before they get taken. It's kinda hard to give the whole story in 80 charachters or less.

yes that one pic does look like fiberglass to me also. should have stated it anyway. buyer beware though.
