You may consider complaining about the fence to the local board because if you leave it to long the property will become theres by way of use. I know there is a proper trem for it but if you don't make them move it it will become there property line & you won't be able to move the fence to the correct placement if you don't force them to move it now. I'd make them move it NOW. Because the longer it stays the harder it will be to make them move it to the proper placement.
